FCC Denial for MAGIC's Radio Station

About three years ago, MAGIC, Matt Polstein's puppet organization, applied to put up a new radio station in the Katahdin Region. 

There were two problems with that  move. 

Number one, the area won't support two competing stations, and WSYY has already held this region for more than 40 years.

Secondly, and more important, the application contained falsehoods.

This morning, approximately 100 people who wrote to the FCC in opposition to this travesty got responses which included the denial of that application.

It is clear from the response that the FCC, while slow, was not fooled.

According to the response, the FCC realized that MAGIC had not been forthcoming about who and what they were, and that their claim that they are NOT an educational organization, despite their claims on the application. 

...we cannot find such a commitment to any "educational" goal in Magic's application, Articles of Incorporation, By-Laws, or pleadings.

However, we advise Magic that very serious questions regarding its financial qualifications remain unresolved. Should Magic seek reconsideration of the dismissal of its application, further Commission inquiry into these matters would be required...Probative evidence necessarily includes something more than the self-serving, uncorroborated statement of the individual responsible for certification...Rather, at least to some extent, Bruce McLean, Magic's Executive Director, appears to have relied on the generalized representations of Dennis Dunbar, based on his "broadcast experience"... [and on Dunbar's] representation that "he has had an FCC First Class Operator's license since the sixties...Under the circumstances, there likely is a substantial and material question regarding whether Magic was financially qualified at the time it filed the Application."


The very end of the document proclaims:

IT IS FURTHER ORDERED that the application of Millinocket Area Growth and Investment Council (File No. BNPED-20071022BQO) for a construction permit for a new noncommercial educational FM station in Millinocket, Maine, IS HEREBY DISMISSED.
